By entering the Promotion, you agree be bound by these Terms & Conditions and acknowledge that you satisfy all eligibility requirements. “Sponsor” means Sterling Jewelers Inc., and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors.

Eligibility. Open to individual legal residents of the 50 United States or the District of Columbia who have a valid Instagram account and are eighteen (18) or older prior to the date of entry (the “Entrant”). Employees of Sponsor and their immediate family members are not eligible to participate. Previous winners of any live events conducted by Sponsor within the past ninety (90) days are not eligible to participate. By participating, Entrants agree to be bound by these Terms & Conditions and the decisions of Sponsor, which shall be final and binding in all respects.

Promotion Period: Starting and ending during the Event to be held on Thursday, December 3, 2020, from approximately 7:30pm EDT to 8:00pm EDT

How to Enter: On Thursday, December 3, 2020 at approximately 7:30pm EDT, Sponsor will host a LIVE Event on https://live.jared.com/ (the “Event”). During the Event, Sponsor will identify one (1) secret word. Entrants may participate in the Promotion by attending the Event and direct messaging the @Jaredthegalleriaofjewelry Instagram account the secret word after it is identified during the Event. The first two (2) Entrants to direct message the @Jaredthegalleriaofjewelry Instagram account the secret word after it is identified during the Event will receive a product from the LeVian® collection, as set forth below. Sponsor will give away a total of two (2) products during the Promotion Period. If Sponsor is unable to contact an Entrant via direct message to verify eligibility and shipping information, or the Entrant does not respond to Sponsor within two (2) hours of initial message, the Entrant may be disqualified (at Sponsor’s sole discretion) and the Entrant who submitted the next direct message with the secret word may be awarded the prize. Limit one (1) winner per household. Odds of winning depend on the total number of eligible Entrants during the Promotion Period.

Product giveaways are non-transferable and not exchangeable for cash. Sponsor reserves the right to substitute a product giveaway of equal or greater value if the advertised product becomes unavailable.

An Entrant, including a potential winner, is not a winner of a prize unless and until Sponsor has completed its verification of Entrant’s eligibility and compliance with these Terms and Conditions.

Winners are responsible for any and all applicable fees, service charges, surcharges all insurance, federal, state, and local taxes, and any other unspecified expenses associated with acceptance or use of the product. Winners will each be required to return a Declaration of Eligibility and Liability/Publicity Release Form, as well as any applicable tax forms. Winners are advised to consult a tax advisor with respect to tax matters.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

Privacy Policy: Any personal information supplied by you to Sponsor will be treated in accordance with these Terms and Conditions, subject to Sponsor’s privacy policy posted at https://www.jared.com/privacy-policy.

LIMITATION OF LIABILITY: Sponsor is not responsible for late, lost, delayed, damaged, incomplete, illegible, or misdirected entries, responses, or other correspondence, phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties. By participating in the Promotion, you release Sponsor from any and all liability with respect to the Promotion or the acceptance, possession or use of any product, including without limitation (i) any condition caused by events beyond Sponsor’s control that may cause the Promotion to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of participation in the Promotion and (iii) any printing or typographical errors in any materials associated with the Promotion; and (iv) any technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in this Promotion, or by any human error which may occur in the processing of this Promotion.. Sponsor’s decisions in all respects relative to the Promotion are final. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Promotion in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Promotion is compromised, without liability. Sponsor reserves the right to disqualify any Entrant, as determined by Sponsor in its sole discretion. Void where prohibited or restricted by law. All federal, state, provincial and local regulations apply.

Additional Conditions: Except where prohibited by law, by accepting the product, Entrants consent to the use of his/her name for advertising and promotional purposes without additional compensation. Entries become property of Sponsor and none will be acknowledged or returned. Allow two (2) weeks for delivery of product via mail. Products will only be delivered to selected Entrants if email addresses & addresses are provided.

DISPUTES: Except where prohibited, Entrants agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state of Ohio or the appropriate Court located in the state of Ohio; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
